The Louisiana Insurance Automobile Law is controlled by the "No
Pay, No Play" statute (LA
R.S. 32:866) . This statute bars motor vehicle owners
who do not have liability insurance from collecting the first ten-thousand
dollars of any bodily injury or property damage resulting from an
automobile accident. This provision does not apply to passengers
in the motor vehicle. Also, accidents caused by drunk drivers or
hit and run drivers are considered exceptions to the mandatory "No
Pay, No Play" law and will allow victims to recover despite
not having any insurance.
In Louisiana, automobile owners must carry at least 10,000/20,000/10,000
liability coverage on their vehicles. Liability coverage pays for
injuries, death or property damages that arise from an automobile
accident. The three numbers represent split coverage. The first
number represents the maximum coverage for one person injured. The
second number represents the maximum coverage for all injuries sustained
in the accident. The third number represents the maximum coverage
for property damage.
It is also mandatory in Louisiana that insurance companies offer
uninsured/under-insured motorist coverage (otherwise referred to
as UM coverage). Uninsured motorist means that there is no liability
coverage at all on the at-fault vehcile. Under-insured means that
the liability limits are inadequate to cover the sustained damages.
UM coverage is governed by Louisiana
Revised Statute 22:1406 (D).
Comprehensive and collision insurance is also available for motorists.
Collision insurance pays for damage to the insured's vehicle. Comprehensive
insurance is available to cover damages other than collision such
as fire, theft, vandalism, flood, and glass damage.
